Legal Notice

These General Conditions apply to all services carried out by the company “Soulkitchen” RCS Tarascon 802 165 595. These General Conditions are sent to the Customer at the same time as the Quote. Any reservation therefore implies full and unreserved acceptance by the Customer of these Conditions, to the exclusion of any other document.

Estimate

Any intervention by Soulkitchen must be the subject of a detailed and personalized estimate given or sent (e-mail, and/or simple letter) to the Customer. This quote includes the designation and type of services determined based on the request expressed by the Customer as well as the related terms and costs. This quote is valid for the month following the date of issue.

The number of guests must be confirmed one (1) month before the date of the event, this will be definitively due.

Reservation of the service

The reservation of the service is made exclusively by the Client with Soulkithen by submitting the Quotation duly accepted and signed accompanied by the reservation check. Due to numerous requests in court on the same days, the reservation will be taken into account upon receipt of a deposit of 30% of the total amount including tax, Check made out to Soulier Frédéric – 1258 rechaussier – 13570 BARBENTANE. In the absence of receipt or cashing of this reservation check, Soulkitchen reserves the right without notice to cancel the service as well as the estimate established.

The rates

The prices expressed on our price list are generally per person and inclusive of tax.

Balance payment

Payment of the total balance of the service is due immediately after the service when the invoice will be given to you. In the absence of payment by the due date and in accordance with law 2008-776 of August 4, 2008, late payment penalties equal to three times the legal rate will be applied, as well as a fixed compensation for recovery costs of 40 euros (decree 2012-1115 of 02/10/2012). However, these penalties will only be payable upon receipt of a formal notice, sent by registered letter with acknowledgment of receipt. No discount in case of early payment.

Any supplement linked to the modification of the service chosen during its execution and/or any deterioration noted in the premises and/or the equipment made available to you will be the subject of invoice(s) for which payment may be made directly. be billed to the Customer.

Cancellation insurance

In the event of cancellation due to its own doing and whatever the causes, the Customer will not be able to claim either the postponement of the event to another date or the reimbursement of the sums already paid and retained by Soulkitchen. as irreducible contractual compensation for contract termination. Soulkitchen therefore strongly advises the Customer to contact their broker/agent and/or insurer in order to take out cancellation insurance for the event and the service.

Responsibilities

The fact that Soulkitchen does not avail itself at any given time of any of the stipulations of the contract cannot be interpreted as a waiver. Soulkitchen is not responsible in particular in the event of:

• any damage caused by the Customer and/or any guest to the equipment and premises of the service provider concerned. Any repairs and reimbursements that may appear necessary following the aforementioned damage will be the sole responsibility of the Customer,
• bodily or material accidents suffered by the Client and/or any guest during the intervention of the service provider concerned,
• theft, loss of funds and valuables belonging to the Client and/or any guest occurring during the execution of the service,
• any damage, direct or indirect, that the Client and/or any guest may cause against the service provider concerned or its employees,
• unavailability of the service provider concerned on the date of performance of the service, particularly in the event of accident, hospitalization or illness of said service provider.

The Customer declares and guarantees that he has full legal capacity allowing him to commit to the contract and that he holds valid civil liability insurance. To this end, the Client undertakes to waive and cause its insurers and/or any guest, where applicable, to waive any recourse against Soulkitchen in the event of the occurrence of any of the aforementioned events. Soulkitchen strongly advises the Customer to contact his broker/agent and/or insurer in order to study with him the validity of his civil liability insurance and the possible subscription of additional insurance concerning the event. The Client undertakes to respect the service provider's own general conditions, of which he declares having received a copy and read prior to the conclusion of the contract. Generally speaking, it is understood between the Client and Soulkitchen that the service provider concerned is solely responsible for the proper execution of the service, it being specified that the liability of each party is limited to the commitments made by it under the terms of the contract.
